Monitoring CHPs

Each year we ask registered community housing providers (CHPs) to provide us with information about their organisation to demonstrate they’re still compliant with the eligibility criteria and performance standards.

The information we ask for is outlined in the Annual Monitoring and Reporting Framework, which sets out our approach for assessing each CHPs compliance for that year.

We also recommend prospective applicants review the framework to develop a full understanding of the annual monitoring requirements they will need to continue to meet if they become registered. Please note, the framework may vary slightly each year, depending on any emerging regulatory issues we may need to better understand.

Annual Regulatory Report

Our annual regulatory report is divided into four parts:

1. Organisational information

This is information which relates to the organisation and its housing operations. From 1 July 2025, this includes completing a property portfolio, which enables us to have a good understanding of the size and geographic location of housing operations.

2. Performance Questionnaire

Each year, we include a questionnaire that is designed to test each CHP’s compliance against the performance standards. These questions may vary slightly from year to year to capture relevant legislative changes and emerging regulatory issues. This allows each CHP to report on their performance, in line with the requirements of Part 10 of the Public and Community Housing Management Act 1992 and to provide additional context to the supporting documentation.

3. Supporting documents

We require a set of supporting documents each year to help us assess compliance with the performance standards.

These include:

·       audited financial accounts in the name of the registered CHP

·       complete budget forecasts for the registered CHP for the next financial year following the provided audited accounts. These must include statements of:

o   income and expenditure

o   cash flows

o   financial position

o   changes in equity (or a reconciliation of opening equity to closing equity)

o   the underlying assumptions upon which the budget forecast is based

·       business and strategic plans (if updated in the past 12 months)

·       details of significant new capital expenditure (planned or undertaken). For example, any new properties purchased or planned to purchase.

4. Declaration

Each annual monitoring report also requires the CHP’s Board Chair to sign a declaration confirming that the CHP continues to meet the required eligibility criteria and performance standards.

Once we have received this information, we will analyse it to ensure that the CHP continues to meet the performance standards and eligibility criteria. We confirm our findings to each CHP through an Annual Regulatory Assessment Letter.

If we identify a possible breach of the eligibility criteria or performance standards, we may issue a regulatory requirement or a monitoring requirement as part of the Annual Regulatory Assessment Letter.

A regulatory requirement indicates that we have identified an issue or issues which may indicate a serious compliance risk. The CHP is then required to take the identified actions to manage the risk and ensure they remain compliant. If these actions are not taken within the time specified in the report, we may suspend or revoke the CHPs registration.

A monitoring requirement indicates that a CHP has failed to meet a non-regulatory requirement under the Public and Community Housing Management Act 1992. This could include failing to fulfil their obligations in reporting to us annually or advising us of a significant change in their operations. When issuing a monitoring requirement, we will ask CHPs to make changes to their processes to ensure the identified requirements are met in the future. If these are not, we may move to revoke a CHP’s registration.

If we identify low risk compliance issues, we may make recommendations to the CHP to mitigate the issue. These are not mandatory and will not affect a CHPs compliance status.

Relationship meetings

We will meet with registered CHPs throughout the year to gain a fuller understanding of their operations and provides another opportunity for the CHPs compliance to be reconfirmed. How often we meet with each CHP will depend on the size, scale and complexity of your operations. These meetings offer the opportunity for us to learn more about your organisation and can also be used to discuss any issues the CHP is facing, to address any compliance concerns or to inform us of any significant changes to operations or events that we need to be aware of, as required through our change and disclosure process.
